How To Register a Trademark in Turkey

The trademark is one of the most important factors of any commercial activity, whether in Turkey or elsewhere, so we offer you the method of registering a trademark in Turkey, and the Industrial Property Organization protects any trademark of any natural or legal person on its territory under the Paris Agreement. The Turkish Trademark Law applies to all Turkish citizens and foreign residents, which means that foreign investors working in Turkey can apply for trademark registration for their business.

There are two ways to register a trademark in Turkey:

• By registering a patent: This is done through a direct request in Turkish to the Turkish Patent Office that includes full details of the trademark with its logo, and is suitable for those who established a company or any business in Turkey. After submitting the application, it is studied and inspected if it is compatible with Turkish law, while the trademark was announced in the official bulletin of the Turkish trademark for a period of 3 months, then it is announced in the official newspapers.
In case the trademark is rejected, the investor can file an objection with the submission of documents proving his objection.
After that, the trademark is added within the Turkish trademark registration system, and then the investor can register his trademark internationally.
The trademark in Turkey has validity period of up to 10 years, which can be extended, noting that the Turkish state has the right to cancel it if the trademark has not been used for a period of 5 years after its announcement.
• Trademark registration through the Madrid Agreement: The investor can register his trademark in Turkey because Turkey is a member of the Madrid Agreement, but the investor must have the nationality of one of the countries participating in the Madrid Agreement.
In this way, the investor is granted an international trademark and then registered in Turkey.
